The Criminal Justice Act (“CJA”) provides for the appointment of counsel in criminal cases to persons who are financially unable to obtain adequate representation. 18 U.S.C. § 3006A(a). In the Southern District of Texas, in cases where the Federal Public Defender has not been appointed to represent a defendant who is entitled to the assistance of appointed counsel, individual defense attorneys are chosen from a federal panel. The Federal Public Defender is charged with assuring that members of the CJA panel are familiar with federal criminal practice.

 

In Federal Court one of the inevitable aspects of the practice is that many times a client is convicted of a crime. In those instances, the lawyers are tasked with representing the client not just through a guilty plea or conviction at trial, but also at sentencing. Sentencing recently has become one of the most important aspects in telling the full story of the client. The CLE’s goal is to provide insight on sentencing strategies beginning with storytelling to mitigation, and, of course, seeking the most effective and appropriate sentence for your client under the law. The CLE will focus its attention on 18 U.S.C. 3553(a) and the Guidelines to help practitioners effectively prepare and represent the client at the sentencing hearing.
