The Federal Public Defender presents this CLE Presentation.   In the federal system, years and years of prison time often hang on the character of a person’s prior convictions. But how do we know which convictions are in or out? The two-worded answer is well known to judges, their law clerks, and federal practitioners alike, and it tends to make them all shudder: the “Categorical Approach.” In this one-hour presentation, AFPD Evan Howze aims to demystify the much-maligned test. He will explain why we have the categorical approach, give you tips for navigating its modified variant, and update you on the latest Supreme Court and Fifth Circuit decisions exploring it.
