The Criminal Justice Act (“CJA”) provides for the appointment of counsel in criminal cases to persons who are financially unable to obtain adequate representation. 18 U.S.C. § 3006A(a). In the Southern District of Texas, in cases where the Federal Public Defender has not been appointed to represent a defendant who is entitled to the assistance of appointed counsel, individual defense attorneys are chosen from a federal panel. The Federal Public Defender is charged with assuring that members of the CJA panel are familiar with federal criminal practice.
White collar defense has typically been categorized as a crime prosecuting wealthy individuals and companies. However, with the recent extension of the statute of limitations in fraud cases like the Paycheck Protection Program (PPP) and other high profile prosecutions, the federal government is investing more time and resources in prosecuting new claims. As members of the bar we have already seen an uptick in cases that require indigent representation in what typically has been reserved for individuals of financial means. The goals for this CLE are to walk a lawyer through a “white collar” case, as well as being able to spot reoccurring themes in the prosecution of these cases, and finally teach other ways to digest voluminous complex cases.
