Lawyers frequently struggle with mental health, but never more than during the very stressful, isolating, and technology centered era of the Coronavirus. This program explores the obstacles and solutions to staying fit to practice law. Relying on statutory confidentiality of TLAP, this course overviews the many resources that lawyers have to take care of themselves and to be fit for the practice of law pursuant to their ethical duties and comply with Rule 8.03 of the Texas Disciplinary Rules of Professional Conduct. The course clarifies the rules and law regarding how lawyers can take care of one another and duties, including staying fit and avoiding burnout, depression, or anxiety problems, and duties to report or resources for lawyers and judges that are impaired from burnout, anxiety, depression, secondary trauma, or dependency on substances and how any impaired lawyers can receive help and meet their ethical obligation to provide zealous representation to clients. It also prepares lawyers regarding fitness, avoidance of impairment, resilience, crisis and suicide prevention strategies and numerous tips for maintaining wellness as an attorney.
